1. Scope

These Terms apply to use of Swapown in Norway for:

• Parking spaces
• Items (Torget)

By using the App, users agree to these Terms.

2. About Swapown

Swapown AS operates a digital marketplace where users may:

• Rent parking spaces
• Swap parking spaces
• Swap items

Swapown acts solely as a technical intermediary platform facilitating communication between users.

Swapown:

• Is not a party to agreements between users
• Does not generate contracts
• Does not store contracts
• Does not provide legal services
• Does not guarantee transactions or performance

All agreements and transactions occur directly between users.

3. User Account

• Minimum age: 18 years
• User is responsible for their account
• Information must be accurate and updated
• Users are responsible for all activity on their account

4. User Responsibility

User must:

• Have the legal right to rent, swap, or dispose of parking spaces or items
• Comply with Norwegian law and local regulations
• Follow housing association and condominium rules where applicable
• Report taxable rental income to the Norwegian Tax Administration (Skatteetaten)

Swapown performs no legal verification of user rights.

5. Platform Protection & Acceptable Use

5.1 Intellectual Property

All rights related to the App, including:

• Software
• Design
• Logos
• Text
• Matching systems
• Databases

belong to Swapown AS or its licensors.

Users are granted a limited, non-exclusive, non-transferable license to use the App.

5.2 Prohibited Use

Users may not:

• Provide false or misleading informatio
• List assets without necessary rights
• Use bots, scraping, or automated systems
• Reverse engineer the App
• Misuse messaging systems
• Circumvent security mechanisms
• Use the platform unlawfully

5.3 Platform Integrity

Swapown may:

• Remove content
• Restrict functionality
• Suspend or terminate accounts

where misuse, fraud, or unlawful activity is suspected.

6. Agreements Between Users

All agreements are made directly between users.

Swapown:

• Is not a party to any agreement
• Does not control agreement terms
• Does not guarantee payment, delivery, or performance
• Is not responsible for disputes between users

Users are free to:

• Create private agreements
• Use verbal agreements
• Create contracts outside Swapown

7. Parking Terms

7.1 Parking Transactions

Users may:

• Rent parking spaces
• Swap parking spaces

All communication and arrangements occur directly between users.

Swapown does not provide contract solutions.

7.2 Responsibility

Users are responsible for:

• Ensuring they have the legal right to use the parking space
• Compliance with condominium or housing association rules
• Accurate listing information

Swapown does not verify ownership or usage rights.

8. Items (Torget)

8.1 Transactions

Torget is based on exchanges between users.

Swapown:

• Only facilitates communication
• Does not participate in transactions
• Does not guarantee quality or authenticity

8.2 Condition

All items are exchanged “as is”.

Users are responsible for:

• Inspecting item condition
• Verifying information
• Arranging delivery or exchange

8.3 No Withdrawal Rights

Withdrawal rights generally do not apply between private individuals.

8.4 Prohibited Items

Users may not list:

• Illegal goods
• Stolen items
• Counterfeit products
• Dangerous products

Swapown may remove listings without notice.

9. Privacy and Personal Data

Swapown processes personal data in accordance with:

• GDPR
• Norwegian privacy legislation

Swapown:

• Does not collect personal identification numbers
• Does not generate contracts
• Does not store private agreements between users

Users are responsible for any information they choose to share with others.

10. Availability

Swapown does not guarantee uninterrupted or error-free availability.

The service may be unavailable due to:

• Maintenance
• Updates
• Technical issues

11. Suspension

Swapown may suspend or terminate accounts in cases of:

• Violation of these Terms
• Misuse of the platform
• Illegal activity
• Risk to users or the platform

12. Limitation of Liability

Swapown is not liable for:

• Disputes between users
• Non-payment
• Losses or damages
• Incorrect listings
• Failure of transactions
• Indirect financial losses

13. Indemnification

Users agree to indemnify and hold harmless Swapown AS from claims, losses, or liabilities arising from:

• User conduct
• Violations of these Terms
• Violations of law or third-party rights

14. App Store

These Terms are between the user and Swapown AS, not Apple.

Apple is not responsible for:

• The App
• Content
• Transactions between users

15. Governing Law

These Terms are governed by Norwegian law.

Disputes shall be resolved by Norwegian courts.

16. Language

In the event of discrepancies, the Norwegian version shall prevail.
